Terms of Service (Allgemeine Geschäftsbedingungen)
1. Scope and Parties – These General Terms and Conditions (GTC) apply to all orders placed through the online shop zarfspirits.ch, operated by: Zarf GmbH, Zipfelstrasse 19, 8302 Kloten, Switzerland. Email: contact@zarfspirits.ch. UID: CH-020.4.084.877-0. By placing an order, you acknowledge that you have read, understood, and agreed to these terms.
2. Legal Age Requirement (Alcohol Protection) – In accordance with Swiss federal and cantonal legislation, the sale of alcoholic beverages to minors is prohibited. Fermented alcohol (wine/cider/beer): minimum age 16 years. Distilled alcohol (spirits/cocktails): minimum age 18 years. By placing an order on zarfspirits.ch, the customer confirms they are at least 18 years of age. We reserve the right to request a copy of an official ID and to refuse delivery if age cannot be verified.
3. Conclusion of Contract – The presentation of products in the online shop does not constitute a legally binding offer. It is an invitation to the customer to place an order. A binding contract is only formed when we confirm your order via email or by delivering the goods.
4. Prices and Payment – Currency: all prices are quoted in Swiss Francs (CHF). VAT: prices include Swiss Value Added Tax (VAT). Shipping: standard delivery costs CHF 11 and is free for orders of CHF 100 or more; express delivery costs CHF 13. Delivery costs are clearly displayed during checkout. Payment methods: we accept credit and debit cards and the other payment methods displayed at checkout. Payment is due immediately upon ordering unless otherwise agreed.
5. Delivery and Shipping – Territory: delivery is restricted to addresses within Switzerland and the Principality of Liechtenstein. Timelines: standard delivery takes 3 business days; express delivery takes 1 business day. Risk: the risk of accidental loss or damage to the goods passes to the customer once the package is handed over to the carrier (e.g. Swiss Post).
6. Right of Withdrawal and Returns – In Switzerland, there is no legal right of withdrawal for online purchases. However, zarfspirits.ch values customer satisfaction. Damaged goods: if a product arrives damaged (e.g. broken bottle), the customer must notify us within 48 hours of receipt with photographic evidence. Errors: if the wrong product was delivered, we will replace it at our expense, provided the bottle remains unopened and the seal is intact.
7. Warranty and Liability – We guarantee that the goods are of the quality described. To the extent permitted by Swiss law, liability for slight negligence, indirect damages, or consequential losses is excluded. We are not liable for damages caused by improper storage or handling by the customer.
8. Data Protection – The collection and processing of personal data are governed by our Privacy Policy, which is compliant with the Swiss Federal Act on Data Protection (FADP). Your data is used solely for order processing and, if requested, for our newsletter.
9. Intellectual Property – All content on zarfspirits.ch (images, text, logos) is the intellectual property of Zarf GmbH or its partners. Any use, reproduction, or distribution without prior written consent is prohibited.
10. Governing Law and Jurisdiction – These terms are governed exclusively by Swiss law. The place of jurisdiction for any disputes arising from this contract is Zurich, Switzerland, unless mandatory consumer protection laws dictate otherwise.
11. Severability Clause – Should any provision of these GTC be or become invalid, the validity of the remaining provisions shall remain unaffected.
